Terms of Service
By creating an account, you agree to these terms. We wrote them plainly because we think you should actually be able to read them.
The service is operated by Parent Memories LLC (“Parent Memories”, “we”, “us”).
Who can use this service
Parent Memories is for adults aged 21 and over. By creating an account you confirm that you are at least 21 years old. Recipients and guardians who receive access after a handover must also be adults.
Your content
You own your videos and audio recordings. By uploading them, you grant us a limited licence to store, encrypt, and deliver them to the people you choose — nothing more. We do not claim any ownership over your content and will never use it for advertising, training, or any purpose other than operating the service for you.
What you must not use this service for
- Threatens, intimidates, or encourages violence against any person
- Facilitates, encourages, or instructs self-harm or suicide
- Constitutes harassment, stalking, or targeted abuse of any individual
- Contains sexual content involving minors
- Is designed to defraud or deceive a recipient
- Violates any applicable law
We reserve the right to suspend accounts and remove content that violates these terms, and to cooperate fully with law enforcement on credible reports of threats or harm. A family member or viewer can report a concern using the report button on any video.
The handover mechanism
You designate a trusted person who will receive access to your account if you stop checking in for your chosen period (30, 60, or 90 days) and all warning steps complete. The handover mechanism operates exactly as described in our how it works page. We do not make any warranty about the legal effect of this mechanism in any particular jurisdiction. We strongly recommend consulting a solicitor or attorney if you have questions about how this interacts with your estate or digital property rights.
The trusted person you designate receives full control of your account after handover, including the ability to watch, download, and delete your videos. Choose this person carefully.
Subscription and billing
Access to Parent Memories requires a paid monthly subscription after the free trial period. Payment is due at the start of each monthly billing period. If a payment fails, we will retry and notify you. We give a generous grace period before restricting access — we will always give you time to download your videos before anything is removed.
You may cancel at any time from your account settings. Cancellation stops future charges and your access continues until the end of the current billing period. We do not offer refunds for the current billing period after cancellation.
Military members verified through ID.me pay nothing during active deployment periods. Standard pricing applies at all other times.
Data deletion
If you delete your account, your videos are held for 30 days to allow download, then permanently deleted. This is irreversible. We cannot recover deleted content after this period.
If your account is suspended for violation of these terms, we may delete your content immediately and without notice. In cases involving illegal material, we will preserve evidence as required by law.
Availability
We aim to keep Parent Memories available at all times but cannot guarantee uninterrupted service. If we ever shut down the service entirely, we will give you at least 90 days notice and the ability to download all your videos before closure.
Limitation of liability
Parent Memories is provided as-is. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the service, including any loss of content. Our total liability to you for any claim will not exceed the amount you paid us in the 12 months before the claim arose.
Changes to these terms
We may update these terms from time to time. For significant changes that affect your rights, we will email you at least 30 days before they take effect. Your continued use of the service after that date constitutes acceptance of the updated terms.
Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
